I believe the current board of directors has not been effective in the planning, execution and funding of the projects they have handled. This site is created by Les Mower to provide communication about the operation and management of our investment in Monterey Condominiums.
Vince and Colleen were illegally appointed to prevent the scheduled nominations and election in 2026.
Under Florida Statute 718.112(2)(d), a board may appoint someone only to fill a vacant seat until the next election.
That phrase is important:
“…until the next regular election.”
If your association already noticed an election, sent out ballots, or announced the annual meeting date, then:
A president cannot legally declare:
“No need for nominations”
“No need for an election”
“I already appointed people”
“We’re skipping the vote”
Those statements contradict the statute and almost certainly your bylaws.
Appointments are meant for unexpected vacancies, not for replacing the democratic process.
If two seats were vacant, the board could appoint temporary directors — but:
This is exactly the kind of maneuver the DBPR views as election interference.
